The appellant withdrew the appeal against the Cantonal Council of State’s resolution approving the municipal zoning plan. The Planning Court of the Territory therefore held that the case had become moot and removed the appeal from its docket. It also ordered that no court fees or expenses be charged. The decision was issued by the Tribunal della pianificazione del territorio in Lugano on 24 November 2000.
Withdrawal of the appeal and mootness; when the appellant expressly withdraws the challenge, the court strikes the case from the roll for lack of object. In such a procedural termination, and absent special circumstances, no court fees or expenses are levied (consid. 1-2).
