The Ticino Tribunal for territorial planning dealt with an appeal against approval of amendments to the municipal zoning plan. At the hearing, the appellants clarified a factual point concerning covered parking spaces and, after the State representative stated that the related document had only indicative value, they withdrew the appeal. The court held that the case had become moot and ordered the appeal struck from the docket. It further decided that no court fees or expenses would be charged.
Withdrawal of an appeal renders the proceedings moot and justifies striking the case from the docket; in such a situation, the court may order that no fees or costs be levied. The dispositive effect follows from the disappearance of the subject matter of the dispute rather than from a merits determination, and the court need not rule on the substantive planning-law objections once the appeal is withdrawn.
