The appellants challenged the State Council’s decision approving an inventory of buildings located outside the building zone of a municipality. During the proceedings, both the municipality and the State Council agreed with the appeal. The Tribunal of Territorial Planning therefore held that the dispute had become moot and removed the appeal from its docket. It also ordered that no court fees or expenses be collected.
Mootness in administrative appeal proceedings; when the opposing public authorities adhere to the appeal and no live dispute remains, the court strikes the case from the docket ex officio. In such a situation, no court fees or expenses are levied where the proceedings are discontinued for lack of object (consid. implicit).
