The Tribunal della pianificazione del territorio dealt with a municipality’s appeal against a Grand Council decision approving a territorial planning measure concerning road correction and a new bridge. After the municipality withdrew the appeal by letter of 11 September 2001, the court held that the case had become moot, struck it from the docket, and ordered that no fees or costs be charged.
Withdrawal of an appeal before the deciding authority renders the proceeding devoid of object; the court must strike the case from the docket. In such a situation, and absent special circumstances, no court fees or expenses are levied (consid. as stated in the dispositive).
