RI 1 appealed against the Cantonal Government's approval of a revision of the municipal zoning plan. Before the court ruled on the merits, the appellant notified on 16 November 2004 that the appeal was withdrawn. The Planning Tribunal therefore declared the proceedings terminated and struck the appeal from the docket. It also ordered that no court fees or costs be charged.
Withdrawal of appeal; striking out from the docket. If the appellant withdraws the appeal, the proceedings become moot and the court removes the case from the docket. In the absence of any further adjudication on the merits, the court may order that no fees or costs be levied, depending on the procedural circumstances (consid. 1-2).
