The Ticino Planning Tribunal dealt with an appeal against the Cantonal State Council’s approval of certain zoning-plan variants. Before judgment, the appellant informed the court by letter dated 14 April 2003 that he was withdrawing the appeal. The President therefore ordered the appeal struck from the docket and decided that no court fees or costs would be levied. The decision was notified to the appellant, the municipality, the territorial planning division, and the State Council.
Withdrawal of appeal; striking from the docket and costs: where the appellant withdraws the administrative appeal before judgment, the court takes note of the withdrawal and discontinues the proceedings by striking the case from the docket; in such circumstances, it may order that no taxes or costs be charged.
