Whether the appeal had to be dismissed as inadmissible for non-payment of the advance on costs after the deadline extension.
The advance on costs was deemed unpaid within the extended period; the court therefore could not enter into the appeal.
Under Art. 138(3)(a) CPC, a notice by registered mail is deemed served when unclaimed after seven days if service was to be expected. Since the procedural relationship began with the filing of the appeal, the appellant had a duty of good faith to ensure that court mail could reach him. He had received the initial fee request but did not ensure delivery of later notices or inform the court of any change of address, which he had to bear.
