Whether the appeal remained pending after the insurer reconsidered its opposition decision and renotified the suspension decision
The appeal became moot because the insurer annulled the challenged decision and granted the appellant a new opposition period.
Under Art. 53 para. 3 LPGA, the insurer could reconsider the appealed decision before forwarding its submissions to the court. By annulling the opposition decision and renotifying the suspension decision, it granted the relief sought, so the court only had to take note of mootness and strike the case from the docket.
