Vorliegen

Entscheides

des

Vormundschaftsamtes provisorisch regelte;

nach Einsicht in die dagegen erhobene Berufung von X___________ vom 6. Februar

2012;

erwägend, dass gemäss Art. 20 Abs. 1 lit. b RPflG bei offensichtlicher Unzulässigkeit

ein Einzelrichter ohne Verhandlung und ohne Schriftenwechsel entscheiden kann;

erwägend, dass der Erlass dringlicher Massnahmen zum Kindesschutz gemäss Art. 56

EGZGB in die Zuständigkeit der Präsidentin des Vormundschaftsamtes fällt, deren

Anordnungen nach Abs. 1 dieser Bestimmung bis zu den Verhandlungen des Amtes

gelten und nach Abs. 2 dieser Bestimmung auf Gesuch eines Betroffenen vom

Vormundschaftsamt bestätigt oder widerrufen werden können;

erwägend, dass es sich bei den dringlichen Massnahmen gemäss Art. 56 EGZGB um

superprovisorische Massnahmen im Sinne von Art. 265 der am 1. Januar 2011 in Kraft

getretenen und vorliegend anwendbaren Schweizerischen Zivilprozessordnung (ZPO)

handelt;

erwägend, dass die ZPO gegen kantonale erstinstanzliche Entscheide über

superprovisorische Massnahmen kein Rechtsmittel vorsieht (BGE 137 III 417 E. 1.3 mit

zahlreichen Hinweisen), weshalb eine Präsidialverfügung nach Art. 56 EGZGB weder

mit Berufung noch mit einem anderen Rechtsmittel angefochten werden kann;

erwägend, dass demnach die Berufung offensichtlich unzulässig ist, weshalb auf sie

nicht einzutreten ist;

erwägend, dass die Kosten dieses Entscheids ausgangsgemäss dem Berufungskläger

aufzuerlegen sind (Art. 106 ZPO), wobei die Gebühr auf Fr. 100.-- festzusetzen ist (Art.

13, 14 Abs. 1, 18 und 19 GTar);

erwägend,

dass

keine

Parteientschädigungen

zuzusprechen

sind,

da

der

Berufungskläger als unterliegende Partei und die Berufungsbeklagte, bei welcher keine

Stellungnahme eingeholt wurde, mangels Aufwands keinen Anspruch auf eine solche

haben (Art. 106 Abs. 1 i.V.m. Art. 95 Abs. 1 und 3 ZPO);

Wird erkannt

Auf die Berufung wird nicht eingetreten.

Die Kosten dieses Entscheides von Fr. 100.-- werden dem Berufungskläger

auferlegt.

Es werden keine Parteientschädigungen zugesprochen.
