In an appeal concerning maintenance, the appellants withdrew their appeal before the Zurich High Court. The court therefore struck the proceedings off. It held that the first-instance cost and compensation order became final upon withdrawal. For the appellate proceedings, the court fixed the fee at CHF 800 and allocated the costs equally between the two appellants. No party compensation was awarded to the respondent because no significant expenses were shown.

Berufung gegen eine Verfügung des Einzelgerichts im vereinfachten Verfah- ren am Bezirksgericht Zürich, 3. Abteilung, vom 7. August 2015 (FP150072-L)
Erwägungen: Mit Schreiben vom 15. November 2015, beim Obergericht eingegangen am 16. November 2015, zogen die Kläger die Berufung zurück (Urk. 39). Das Verfah- ren ist entsprechend abzuschreiben. Mit dem Rückzug wird auch die erstinstanzliche Regelung der Kosten- und Entschädigungsfolgen rechtskräftig. Ausgangsgemäss sind die Prozesskosten des Rechtsmittelverfahrens der Klägerin 1 und dem Kläger 2 je zur Hälfte aufzuer- legen (Art. 106 Abs. 1 und 3 ZPO). Mangels erheblicher Umtriebe ist der Beklagten für das Rechtsmittelverfahren keine Parteientschädigung zuzu- sprechen.
Es wird beschlossen: 1. Das Verfahren wird abgeschrieben. 2. Die zweitinstanzliche Entscheidgebühr wird auf Fr. 800.– festgesetzt. 3. Die Kosten des Berufungsverfahrens werden der Klägerin 1 und dem Klä- ger 2 je zur Hälfte auferlegt. 4. Es werden keine Parteientschädigungen zugesprochen. 5. Schriftliche Mitteilung an die Parteien, an die Beklagte unter Beilage des Doppels von Urk. 39, sowie an die Vorinstanz, je gegen Empfangsschein. Die erstinstanzlichen Akten gehen nach unbenütztem Ablauf der Rechtsmit- telfrist an die Vorinstanz zurück. 6. Eine Beschwerde gegen diesen Entscheid an das Bundesgericht ist i nnert 30 Tagen von der Zustellung an beim Schweizerischen Bundesgericht, 1000 Lausanne 14, einzureichen. Zulässigkeit und Form einer solchen Be- schwerde ri chten si ch nach Art. 72 ff. (Beschwerde in Zivilsachen) oder
Art. 113 ff. (subsidiäre Verfassungsbeschwerde) in Verbindung mit Art. 42 des Bundesgesetzes über das Bundesgericht (BGG). Dies ist ein Endentscheid im Sinne von Art. 90 BGG. Es handelt sich um eine vermögensrechtliche Angelegenheit. Der Streitwert beträgt Fr. 185'000.–. Die Be- schwerde an das Bundesgericht hat keine aufschiebende Wirkung. Hinsichtlich des Fristenlaufs gelten die Art. 44 ff. BGG.
