für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 32,50 € zuzüglich Zinsen in Höhe von 5 Prozentpunkten über dem Basissatz seit dem 29. 8. 2004 zu zahlen.

Die Beklagte hat die Kosten des Rechtsstreits zu tragen.

Das Urteil ist vorläufig vollstreckbar.

Das Urteil ergeht gemäß § 313a ZPO ohne Tatbestand.
