In dem Rechtsstreit

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 01.04.2010

für Recht erkannt:

Es wird festgestellt, dass der Beklagten aus der Angelegenheit P ./. B., bei der Beklagten geführt unter der Leistungsnummer xxxxx, kein Anspruch auf Ersatz vorgerichtlicher Rechtsanwaltskosten gegenüber dem Kläger zusteht.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar.
