Tenor

Unter Abweisung der Klage im übrigen wird die Beklagte verurteilt, an den Kläger 237,61 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz jährlich seit dem 18.06.2013 zu zahlen.

Die Kosten des Rechtsstreits tragen der Kläger zu ¾ und die Beklagte zu ¼.

Das Urteil ist vorläufig vollstreckbar.

Den Parteien wird jeweils nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des aus dem Urteil vollstreckbaren Betrages abzuwenden, sofern nicht die jeweils vollstreckende Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
