The plaintiffs challenged a modernization rent increase announced by the defendant on 4 September 2014. The Aachen District Court declared that they were not required to pay the additional €103.06 per month, which would have raised the monthly base rent from €422.15 to €525.21 from 1 December 2014. The defendant was ordered to bear the costs of the proceedings. The judgment is provisionally enforceable; the defendant may avert enforcement of costs by providing security of 110% of the enforceable amount, unless the plaintiffs provide the specified security before enforcement.

Es wird festgestellt, dass die Kläger nicht verpflichtet sind, aufgrund der Modernisierungsmieterhöhungserklärung der Beklagten vom 04.09.2014 mit Wirkung ab dem 01.12.2014 eine um 103,06 € (von 422,15 € auf 525,21 €) erhöhte monatliche Grundmiete an die Beklagte zu leisten.
Die Kosten des Rechtsstreits hat die Beklagte zu leisten.
Das Urteil ist vorläufig vollstreckbar. Die Beklagte darf die Vollstreckung wegen der Kosten durch Sicherheitsleistung in Höhe von 110% des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die Kläger vor der Vollstreckung Sicherheit in Höhe von 110% des jeweils zu vollstreckenden Betrages leisten
