In this first-instance civil judgment, the Local Court of Eschweiler ordered the defendant to deliver and transfer a VW Golf Cabrio to the plaintiff against €1, the sole bid made before the defendant ended the eBay auction early. The court also found the defendant in default of accepting payment and assigned her the litigation costs. It applied the principle that an auction may be ended for serious circumstances discovered after listing, including pre-existing defects unknown to the seller, but required the seller to contact bidders and provide specific details about the defect and the timing of its discovery and response. The brief interval, the unanswered buyer inquiry, and the unexplained termination heightened the defendant’s burden of explanation.

BGB § 433; premature termination of an eBay auction. A seller’s right to end an auction for cause may also cover serious circumstances that already existed when the offer was posted, if the seller learned of them only later and neither knew nor ought to have known of them beforehand (following Regional Court of Bonn, judgment of 5 June 2012, 18 O 314/11, paras. 34, 48 f.). Where the seller becomes aware after listing of a significant pre-existing defect, the seller must contact bidders who have already appeared before terminating the auction. If the seller fails to do so, the seller must specifically explain the grounds for termination and the relevant chronology, including the auction’s start, when the information was acquired, and when the seller reacted. The duty to substantiate lack of prior knowledge is heightened where the auction is ended very soon after the sole bid, without reasons, and after the seller has declined to answer the bidder’s questions.

The defendant was required to deliver and transfer the car to the plaintiff against payment of €1.

An early termination may be justified by serious circumstances discovered only after listing, even if they already existed then, provided the seller was previously unaware and could not reasonably have known. The seller must contact bidders and explain the circumstances and timing; heightened substantiation was required given the short interval and refusal to answer the sole bidder’s questions.

The defendant was in default in accepting the purchase price.

The defendant bears the costs of the proceedings.
