The applicant asked Eschweiler District Court to order the respondent to return an enforceable child-support title after the child moved into the household of the person formerly liable for cash maintenance. The court granted the request, applying BGB § 371 by analogy, and ordered surrender of the enforceable copy of the 2016 default decision. It also ordered the respondent to indemnify the applicant for €120.48 in out-of-court legal costs relating to advice in a matter involving Jobcenter Städteregion B. BGB § 371 by analogy; surrender of a maintenance enforcement title following a change in the child’s household. Bei einem Wechsel des Kindes in den Haushalt des bisher Barunterhaltspflichtigen steht diesem ein Anspruch auf Herausgabe des Unterhaltstitels gegen den bisherigen Unterhaltsgläubiger zu.
Der Antragsgegner wird verpflichtet, die vollstreckbare Ausfertigung des Versäumnisbeschlusses des Amtsgerichts Eschweiler vom 05.01.2016 - 00 F 000/15 AG Eschweiler - an den Antragsteller herauszugeben.
Der Antragsgegner wird darüber hinaus verpflichtet, den Antragsteller von 120,48 € außergerichtlicher Rechtsanwaltskosten betreffend die Forderung der Rechtsanwälte X & N in F aus der Beratung in dem Verfahren K / T (Jobcenter Städteregion B) (000/17 M02) freizustellen.
Die Kosten des Verfahrens trägt der Antragsgegner.
