In this first-instance civil judgment, the District Court of Arnsberg ordered the defendant to pay the plaintiff €2,580, interest at five percentage points above the base rate from 6 December 2011, and €318.68 in pre-litigation reminder and legal fees. The court dismissed the action insofar as it sought further ancillary amounts and ordered the defendant to bear the costs of the proceedings. Der Beklagte wird verurteilt,
an die Klägerin 2.580,00 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 06.12.2011 sowie 318,68 € vorgerichtliche Mahn- und Anwaltskosten zu zahlen.
Im Umfang der darüber hinausgehenden Nebenforderungen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt der Beklagte.
Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 % des beizutreibenden Betrages vorläufig vollstreckbar.
