Tenor

Der Vollstreckungsbescheid des Amtsgerichts Wedding vom 4.9.2014 – Az.: 14-0800542-0-8 wird aufgehoben.

Die Klage wird abgewiesen.

Die Klägerin trägt die Kosten des Rechtsstreits mit Ausnahme der Kosten der Säumnis des Beklagten, die im Mahnverfahren entstanden sind.

Das Urteil ist vorläufig vollstreckbar. Die Klägerin und der Beklagte dürfen die Vollstreckung gegen Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht der Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
