The plaintiffs sought relief against the occasional entry of other residents’ cats into their apartment or onto their balcony. The District Court Bonn dismissed the claim and ordered the plaintiffs to bear the costs. It held that residents of a multi-unit building generally must tolerate such occasional entry. An entitlement to restrict the interference arises only when the burden is excessive and exceeds the reasonable limit; the neighborly relationship also requires the affected resident to show consideration and accommodation. The decision’s annotation states that it was partly set aside by the Regional Court Bonn on 6 October 2009.

BGB §§ 823, 1004 and 242; occasional entry of a neighbor’s cat into another resident’s apartment or onto a balcony in a multi-unit building. Such interference is generally to be tolerated as part of the reciprocal obligations arising from the neighborly community relationship. A claim to restrict the interference requires a burden that is excessive and exceeds the threshold of reasonableness. In assessing that threshold, the affected resident must also exercise consideration and show a willingness to accommodate others. The decision does not establish an absolute right to prevent animals from entering; the decisive question is whether the particular interference imposes an unreasonable burden.

Occasional entry by neighbors’ cats must generally be tolerated; restrictions are justified only where the resulting burden is excessive and exceeds what is reasonable.

In a multi-unit building, the neighborly relationship requires residents both to show consideration and to accept reasonable accommodation. The stated circumstances did not establish an excessive burden.
