The plaintiff brought a civil claim against the defendant arising from damage to a textile item entrusted for cleaning. The Bonn Local Court held that clause 2 of the delivery terms of the German Textile Cleaning Trade applies correspondingly when damage to a customer's textile is caused by the condition of other textiles cleaned in the same cycle. It ordered the defendant to pay EUR 187.50, with interest at five percentage points above the base rate from 11 October 2008, and dismissed the remainder of the claim. The plaintiff was ordered to bear 49% of the costs and the defendant 51%.
BGB § 631; applicability of clause 2 of the delivery terms of the German Textile Cleaning Trade to damage caused by other textiles cleaned in the same cycle. The provision applies correspondingly where a customer’s textile is damaged because of the condition of other textiles processed in the same cleaning cycle. Its application is not confined to damage arising from the condition of the individual item entrusted by the customer; it also governs the risk of damage attributable to other items cleaned together with it.

Ziff. 2 der Lieferbedingungen des Deutschten Textilreinigungsgewerbes findet entsprechende Anwendung, wenn an einem Textilstück, das der Kunde zur Reinigung gibt, ein Schaden wegen der Beschaffenheit anderer Textilstücke eintritt, die im gleichen Reinigungsgang mitgereinigt wurden.
Der Beklagte wird verurteilt, an den Kläger 187,50 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 11.10.2008 zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen der Kläger zu 49 % und der Beklagte zu 51 %.
Das Urteil ist vorläufig vollstreckbar.
