Bonn District Court rejected the notary's 2 April 2014 application to delete the testamentary-executor notice recorded in Section II no. 3 for property entered in the Mehlem land register, sheet 809. The court held that under Section 52 GBO, testamentary execution must be registered even if it is subject to a condition precedent. The rejection was at the applicant's expense.
GBO § 52; entry of a testamentary-executor notice in the land register: Testamentary execution must be entered in the land register even where it is subject to a condition precedent. The conditional nature of the execution does not preclude registration of the notice.
