In a mobile-telephony billing dispute, Bonn Local Court partially set aside its default judgment of 4 July 2014 and entered a new judgment. It ordered the defendant to pay the provider €312.11, with interest from 8 May 2011, and dismissed the rest of the claim. The court stated that a mobile provider’s duty of care requires a cut-off that interrupts service and warns the customer when internet use is unusual. For domestic use, the cut-off threshold should be based on a multiple of the €50 amount specified by the EU roaming regulation. The defendant bears 14% of costs; the plaintiff bears the remaining 86% and the costs caused by the default.
