  1. Es besteht keine Befugnis der Gemeinschaft, dem einzelnen Wohnungseigentümer außerhalb der gemeinschaftlichen Kosten und Lasten Leistungspflichten aufzuerlegen.

  2. Wohnungseigentümer können zu einer eigenständigen Anbringung und Wartung von Rauchmeldern nicht durch Mehrheitsbeschluss der Eigentümerversammlung verpflichtet werden.

Tenor

Es wird festgestellt, dass der Beschluss der Eigentümerversammlung der WEG I-Straße ##-## in C-S zu Tagesordnungspunkt 10 vom 22.05.2014 nichtig ist.

Die Kosten des Rechtsstreits tragen die Beklagten.

Das Urteil ist vorläufig vollstreckbar. Die Beklagten können die Vollstreckung durch Sicherheitsleistung in Höhe von 1.000,00 € abwenden, wenn nicht der Kläger zuvor Sicherheit in gleicher Höhe leistet.
