The Bonn Local Court ordered the defendant to pay the plaintiff €495.65 in rental-car costs, interest at 5 percentage points above the base rate from 5 May 2015, and €70.20 in pre-litigation legal fees. The defendant was also ordered to bear the costs of the proceedings. The court held that, when estimating the ordinary rental tariff under ZPO § 287, it could rely on the Schwacke rental price survey for the relevant postal-code area.

In Ausübung des tatrichterlichen Ermessens gemäß § 287 ZPO kann der Normaltarif der Mietwagenkosten auf der Grundlage des Schwacke-Mietpreisspiegels im maßgeblichen Postleitzahlgebiet berechnet werden.
Die Beklagte wird verurteilt, an die Klägerin 495,65 Euro nebst 5 % Zinsen über dem Basiszinssatz seit dem 05.05.2015 nebst vorgerichtlicher Rechtsanwaltskosten in Höhe von 70,20 Euro zu zahlen.
Die Kosten des Rechtsstreits trägt die Beklagte.
Das Urteil ist vorläufig vollstreckbar.
