Tenor

Es wird festgestellt, dass die vom Beklagten mit Schreiben vom 05.02.2018 gegenüber dem Kläger ausgesprochene außerordentliche Kündigung der Vereinsmitgliedschaft unwirksam ist.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist vorläufig vollstreckbar. Der Beklagte kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110% des aufgrund des Urteils vollstreckbaren Betrages abwenden, sofern nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 110% des jeweils zu vollstreckenden Betrages leistet.
