The applicant challenged the court officer’s 18 November 2009 decision concerning Beratungshilfe. The Bochum Local Court treated the challenge as a permissible reminder under §§ 11 and 24a RPflG and § 6(2) BerHG but found it unfounded. It adopted the court officer’s reasoning that alternative advice was available. The court added that the Bochum City Youth Welfare Office regularly undertakes child-support guardianships under § 1712 BGB and may bring claims, and that local family courts had confirmed both this practice and the staff’s expertise. The reminder was rejected, and out-of-court expenses were not reimbursed.

§ 1(1) no. 2 BerHG; alternative advisory assistance as a ground to deny Beratungshilfe: Beratungshilfe is unavailable where another reasonable means of obtaining advice exists. The assessment may take account of whether a public authority regularly provides assistance in the relevant matters and whether its staff has the necessary expertise. In child-support matters, the youth welfare office’s regular assumption of guardianships under § 1712 BGB, including the possibility of bringing a claim, may constitute such an alternative. The availability of that assistance is supported where the practice and relevant staff expertise are confirmed by the family courts.

In der Betratungshilfesache

betreffend
