Tenor

I.

Die Beklagte wird verurteilt, an den Kläger EUR 265,62 nebst Zinsen in Höhe von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 04.11.2016 zu zahlen sowie den Kläger von Gebührenansprüchen des Herrn M, C2, … E, in Höhe weiterer Euro 35,11 freizustellen.

Es wird festgestellt, dass die Beklagte verpflichtet ist, dem Kläger 80 % der materiellen Schäden, die dem Kläger in Zukunft aus dem Verkehrsunfall vom … auf dem Q4 an der X-Straße, … C, entstehen, zu ersetzen.

Im Übrigen wird die Klage abgewiesen.

II.

Die Kosten des Rechtsstreites tragen der Kläger zu 72 % und die Beklagte zu 28 %.

III.

Das Urteil ist vorläufig vollstreckbar. Dem jeweiligen Vollstreckungsschuldner wird nachgelassen, die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des aufgrund des Urteils vollstreckbaren Betrages abzuwenden, wenn nicht der jeweilige Vollstreckungsgläubiger vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
