Tenor

  1. Die Beklagten werden als Gesamtschuldner verurteilt, an den Kläger 422,45 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 08.05.2008 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

  1. Die Kosten des Rechtsstreits werden dem Kläger zu 42 % und den Beklagten zu 58 % auferlegt.

  2. Das Urteil ist vorläufig vollstreckbar.

Den Parteien bleibt nachgelassen, die Zwangsvollstreckung durch die jeweils andere Partei mittels Sicherheitsleistung in Höhe von 120 % des aufgrund des Urteils vollstreckbaren Betrages abzuwenden, wenn nicht die vollstreckende Partei vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.

  1. Die Berufung wird zugelassen.
