Tenor

Der Beklagte wird verurteilt, an die Klägerin 3.002,80 Euro nebst Zinsen in Höhe von 5 %-Punkten über dem Basiszinssatz seit dem 06.03.2008 und 122,85 Euro nebst Zinsen in Höhe von 5 %-Punkten über dem Basiszinssatz seit dem 26.09.2008 sowie 4,00 Euro Mahnkosten zu zahlen, abzüglich am 25.08.2008 gezahlter 2.000,00 Euro und abzüglich weiterer am 17.07.2009 gezahlter 998,00 Euro.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden dem Beklagten auferlegt.

Das Urteil ist vorläufig vollstreckbar.

Eine Berufung ist nicht zulässig.
