für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 155,85 DM nebst 4 % Zinsen

seit dem 8. September 1994 zu zahlen. Im übrigen wird die Klage abge-

wiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 83 % und die Beklagte

zu 17 %.

Das Urteil ist vorläufig vollstreckbar.

Von der Darstellung des Tatbestandes wird gemäß § 495 a Abs. 2 Satz 1 ZPO abge-sehen.
