Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 17. April 1998

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger

1.895,00 DM nebst 4 % Zinsen seit dem 05.11.96

zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Beklagte trägt die durch die Beweisan-

ordnung verursachten Kosten. Von den übrigen

Kosten des Rechtsstreits trägt der Kläger

1/10 und die Beklagte 9/10.

Das Urteil ist vorläufig vollstreckbar, für

den Kläger jedoch nur gegen Sicherheits-

leistung in Höhe von 3.000,00 DM. Der Kläger

kann die Vollstreckung durch Sicherheits-

leistung in Höhe von 50,00 DM abwenden,

wenn nicht die Beklagte vor der Vollstreckung

Sicherheit in gleicher Höhe leistet.
