The applicants sought an order preventing the respondent from contacting them directly about her 17 January 2000 rent-increase demand while their lawyer’s mandate remained in force. After an oral hearing, Düsseldorf Local Court granted the request and prohibited personal contact, including by letter, bypassing counsel. It threatened an administrative fine of up to DM 5,000 for each violation, or detention of up to one month if the fine could not be collected. The respondent was ordered to bear the costs of the proceedings.

für R e c h t erkannt:
Der Antragsgegnerin wird untersagt, im Rahmen der au-
ßergerichtlichen Auseinandersetzung zu ihrem Mieterhö-
hungsverlangen vom 17.01.2000 die Antragsteller per-
sönlich, unter Umgehung ihres Bevollmächtigten, Herrn
Rechtsanwalt X, zu kontaktieren, insbe-
sondere anzuschreiben, so lange das Mandat besteht.
Der Antragsgegnerin wird für jeden Fall der Zuwider-
handlung ein Ordnungsgeld in Höhe von bis zu 5.000,--
DM und für den Fall, daß dieses nicht beigetrieben
werden kann, Ordnungshaft von bis zu einem Monat ange-
droht.
Die Antragsgegnerin trägt die Kosten des Verfahrens.
