Following an oral hearing on 17 October 2001, Düsseldorf Local Court ordered the defendant not to use parking spaces on the outdoor deck of the property at Xstraße 8, X, that are identifiable as the plaintiff’s spaces by the plaintiff’s company emblem. Use is permitted only if expressly authorized by the plaintiff or XXX GmbH and/or Co.KG. The prohibition is backed by a coercive fine of up to DM 500,000 for each violation or, alternatively, coercive detention of up to six months.

Der Beklagte wird verurteilt, es bei Meidung eines für jeden Fall der Zuwiderhandlung vom Gericht festzusetzenden Ordnungsgeldes bis zu 500.000,00 DM, ersatzweise Ordnungshaft bis zu sechs Monaten, Ordnungshaft bis zu 6 Monaten zu unterlassen, solche Parkplätze auf dem Außenparkdeck des Objekts Xstraße 8 in X, die durch ein Firmenemblem der Klägerin, als deren Parkplätze erkennbar sind, zu benutzen, soweit ihm dies nicht von der Klägerin oder der XXX GmbH und/oder Co.KG ausdrücklich gestattet wird.

The defendant must refrain from using those spaces unless expressly permitted by the plaintiff or XXX GmbH and/or Co.KG.
