Sintesi Omnilex

The cost debtor challenged the assessment of a fee for forwarding files, arguing against the charge connected with returning them. The Düsseldorf Local Court held the reminder admissible but unfounded. It interpreted the €12 flat fee under item 9003 of the Court Fees Act schedule as covering the court’s or prosecutor’s office’s handling costs for both sending and receiving the files. The provision did not establish a separate duty to reimburse a lawyer’s expenses for returning them. The court rejected the reminder, ordered the cost debtor to pay the costs of the reminder proceedings, and allowed a complaint because the matter was of fundamental importance.

Nr. 9003 KV GKG; scope of the flat fee for forwarding files. The flat fee covers the expenses incurred by the court or public prosecutor’s office for both dispatching and receiving the files. It does not, without an express statutory basis, entail reimbursement of a lawyer’s expenses for returning files. Such reimbursement would be an exception within the statutory system of costs; the wording of Nr. 9003 KV GKG gives no indication that the legislature intended to create one.

Tenor

The €12 flat fee covers the court’s or prosecutor’s office’s effort for both dispatch and return, but does not create an obligation to reimburse a lawyer’s return expenses.

The statutory provision, read in context, covers the institution’s expenses for sending and receiving the files. Its wording provides no basis for an exceptional reimbursement obligation for a lawyer’s expenses.

The cost debtor must bear the costs of the reminder proceedings.
