für R e c h t erkannt:

Der Beklagte wird verurteilt, an die Klägerin 282,75 € nebst Zinsen in Höhe

von fünf Prozentpunkten über dem jeweiligen Basiszinssatz seit dem

26.5.2004, 6,00 € vorgerichtliche Mahnkosten sowie 29,25 € nicht anrechen-

bare Rechtsanwaltskosten zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits hat die Klägerin 42 % und der Beklagte

58 % zu tragen.

Das Urteil ist vorläufig vollstreckbar.
