Following an oral hearing on 31 August 2006, the District Court of Düsseldorf ordered the defendant to pay the plaintiff €1,200, interest from 17 September 2005 at five percentage points above the applicable base rate, and €95 in unrecoverable out-of-court legal fees. für R e c h t erkannt:
Die Beklagte wird verurteilt, an den Kläger 1.200,- EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 17.09.2005 sowie nicht anrechenbare außergerichtliche Rechtsanwaltskosten in Höhe von 95,- EUR zu zahlen.
Im übrigen wird die Klage abgewiesen.
Von den Kosten des Rechtsstreits hat der Kläger 3 % und die Beklagte 97 % zu tragen.
Das Urteil ist vorläufig vollstreckbar. Die Beklagte darf die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des aus dem Urteil insgesamt vollstreckbaren Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
