für R e c h t erkannt:
Die Beklagte wird verurteilt, an die Klägerin zu 2. 332,36 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 14.02.2006 sowie vorgerichtliche Rechtsanwaltskosten in Höhe von 40,72 € zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Gerichtskosten und die außergerichtlichen Kosten der Beklagten werden dem Kläger zu 1. zu 35 %, der Klägerin zu 2. zu 53 % und der Beklagten zu 12 % auferlegt.
Die außergerichtlichen Kosten des Klägers zu 1. trägt dieser selbst.
Die außergerichtlichen Kosten der Klägerin zu 2. trägt sie selbst zu 81 % und die Beklagte zu 19 %.
Das Urteil ist vorläufig vollstreckbar.
Die Parteien können die Vollstreckung gegen Sicherheitsleistung in Höhe des jeweils zu vollstreckenden Betrages abwenden, wenn die jeweils gegnerische Partei nicht vor der Vollstreckung in gleicher Höhe Sicherheit leistet.
