für Recht erkannt:

Die Beklagte wird verurteilt, an den Kläger 2.694,03 € nebst Zinsen in Höhe von 5%-Punkten über dem Basiszinssatz seit dem 28.02.2007 zu zahlen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar gegen Sicherheit in Höhe von 110% des jeweils vollstreckbaren Betrages.

Der Streitwert wird auf 2.694,03 € festgesetzt.
