durch den Richter am Amtsgericht X

für R e c h t erkannt:

Der Beklagte wird verurteilt, an den Kläger 824,27 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 10.08.2007 zu zahlen.

Die Widerklage wird abgewiesen.

Die Kosten des Rechtsstreits mit Ausnahme der durch die Widerklage der Streithelferin verursachten Kosten sowie der Kosten der Streithelferin trägt der Beklagte. Die Streithelferin trägt ihre Kosten sowie die durch ihre Widerklage verursachten Kosten selbst.

Das Urteil ist vorläufig vollstreckbar. Der Beklagte darf die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des aus dem Urteil insgesamt vollstreckbaren Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
