Die Beklagte wird verurteilt, an den Kläger 750 EUR nebst jährlichen Zinsen in
Höhe von 5%-Punkten über dem jeweiligen Basiszinssatz aus 250 EUR seit
dem 15.08.2006 und aus 500 EUR seit dem 21.11.2007 zu zahlen; im Übrigen
wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt die Beklagte.
Das Urteil ist vorläufig vollstreckbar. Die Beklagte darf die
Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 120 % des auf
Grund des Urteils vollstreckbaren Betrages abwenden, wenn nicht der Kläger
vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu
vollsteckenden Betrages leistet.
