Die Beklagte wird verurteilt, an den Kläger € 214,29 zzgl. Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 22.12.2007 sowie € 39,00 zzgl. Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 01.02.2008 zu zahlen.

Die Kosten des Rechtsstreits werden der Beklagten auferlegt.
