für Recht erkannt:

Das Urkundsvorbehaltsurteil vom 10.09.2008 wird aufgehoben. Die Klage wird abgewiesen. Auf die Widerklage wird festgestellt, dass der Klägerin gegen die Beklagte aus dem Internet-System-Vertrag vom 14.06.2007, Vertrags-Nr. xxxxx, keinerlei weiteren Ansprüche gegen die Beklagte zustehen.

Die Kosten des Rechtsstreits trägt die Klägerin mit Ausnahme der Kosten der Säumnis der Beklagten, die die Beklagte trägt.

Das Urteil ist vorläufig vollstreckbar. Die Klägerin darf die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages abwenden, wenn nicht die Beklagte vor Vollstreckung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages leistet.
