Die Beklagte wird verurteilt, vorgerichtliche Rechtsanwaltskosten in Höhe von 39,00 an die Klägerin zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Klägerin zu 76 %, die Beklagte zu 24 %.
