hat das Amtsgericht Düsseldorf

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 28.07.2010

durch die Richterin X

für Recht erkannt:

Die Beklagte wird verurteilt, an die Klägerin 428,00 € nebst Zinsen in Höhe von 5%-Punkten über dem Basiszinssatz seit dem 12.02.2010 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt die Beklagte zu 75 %, die Klägerin zu 25 %.

Das Urteil ist vorläufig vollstreckbar.

Die Berufung wird nicht zugelassen.
