für R e c h t erkannt:

Der Beklagte wird verurteilt, an die Klägerin 761,73 Euro nebst Zinsen in Höhe von 5 %-Punkten über dem Basiszinssatz, aus 522,33 Euro seit dem 06.01.2010 und aus jeweils 47,88 Euro seit dem 06.01.2010, 06.02.2010, 06.03.2010, 08.04.2010 und 06.05.2010 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Klägerin zu 33 % und der Beklagte zu 67 %.

Das Urteil ist vorläufig vollstreckbar. Dem Beklagten bleibt nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 120 % des zu vollstreckenden Betrages abzuwenden, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
