Die Beklagte wird verurteilt, die Klägerin von den Kosten der X & X Rechtsanwälte Partnerschaft in Höhe von € 948,43 nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 19.09.2009 freizustellen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits werden der Beklagten auferlegt.
Dieses Urteil ist vorläufig vollstreckbar.
Die Beklagte darf die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 1.200,00 Euro abwenden, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in Höhe von 1.200,00 Euro leistet.
