für R e c h t erkannt:

Das Versäumnisurteil des Amtsgerichts Düsseldorf vom 19.8.2010 wird teilweise aufgehoben und insgesamt wie folgt neu gefasst:

Der Beklagte wird verurteilt, an die Klägerin 639,29 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz aus 582,35 € seit dem 25.7.2007 und aus 56,94 € seit dem 25.8.2007 sowie 10,00 € Mahnkosten und Auskunftskosten in Höhe von 1,30 € zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Der Beklagte hat die Kosten des Rechtsstreits zu tragen bis auf die Kosten, die durch die Säumnis der Klägerin entstanden sind, die diese zu tragen hat.

Das Urteil ist vorläufig vollstreckbar.

Die Parteien können die Vollstreckung durch Sicherheitsleistung in Höhe von jeweils 110 % des jeweils vollstreckbaren Betrages abwenden, wenn nicht die jeweils vollstreckende Partei vor der Vollstreckung Sicherheit in Höhe von jeweils 110 % des jeweils zu vollstreckenden Betrages leistet.
