hat das Amtsgericht Düsseldorf

durch die Richterin am Amtsgericht X

für Recht erkannt:

Es wird festgestellt, dass dem Beklagten keine Ansprüche, insbesondere keine Schadensersatzansprüche aus der Demontage des Gaszählers, Nummer xxx xxx, vom 26.08.2009 unter der Anschrift X Straße xxx, XXX, gegenüber der Klägerin zustehen.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist hinsichtlich der Kosten vorläufig vollstreckbar. Dem Beklagten wird nachgelassen, die Vollstreckung der seitens der Klägerin durch Leistung einer Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages abzuwenden, wenn nicht die Klägerin vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
