Tenor

Es wird festgestellt, dass die Mitversicherung unter der Versicherungsnummer XXX für die versicherte Person L, geb. am XXX, zum 30.04.2011 erloschen ist.

Die Beklagte wird verurteilt, an den Kläger 704,87 € nebst Zinsen in Höhe von 5-%-Punkten über dem Basiszinssatz aus 360,65 € ab dem 17.11.2011 und aus weiteren 344,22 € ab dem 07.05.2012 zu zahlen.

Die Beklagte wird ferner verurteilt, an den Kläger vorgerichtliche Rechtsanwaltskosten von 316,18 € zu zahlen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Der Beklagten wird gestattet, die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrags abzuwenden, wenn nicht vor der Vollstreckung der Kläger Sicherheit in gleicher Höhe leistet.
