Tenor

Die Beklagte wird verurteilt, an den Kläger 5 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 12.5.2011 sowie weitere 83,54 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 7.12.2011 zu zahlen.

Die weitergehende Klage wird abgewiesen.

Die Kosten des Rechtsstreits tragen der Kläger zu 3/5 und die Beklagte zu 2/5.

Das Urteil ist vorläufig vollstreckbar. Den Parteien wird nachgelassen, die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 110 % des jeweils beizutreibenden Betrages abzuwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
